Warranty and purchase conditions
Warranty, deadline for the submission of claims and disputes
Audiomarket.ee (Audiomarket OÜ) mediates the producer’s warranty for the goods on sale. The warranty gives the buyer, within the warranty period, the right to demand the free repair or replacement of the goods. The warranty is valid in the territory of the Republic of Estonia.
The time for the submission of claims against the product warranty is 2 years from the date the order was placed. It must be thereby taken into consideration that if the goods show defects within 6 months of their purchase, it will be assumed that they were already present when the goods were purchased unless the seller proves otherwise. The consumer, after the 6 month period from the purchase of the goods has elapsed, must prove that the defect is a production defect and not a defect caused by improper use.
Attempts will be made to resolve disputes through negotiation. If an agreement is not achieved, disputes will be settled by a court proceeding in the court according to the legislation currently valid in the Republic of Estonia. The client has the right to turn to the Consumer Protection Authority for an out of court settlement of a dispute arising from the contract. The use of the right to turn to the Consumer Protection Authority does not remove from the Client the right to turn to the court for the settlement of the dispute. Purchase conditions
The owner of the www.audiomarket.ee online shop (hereafter online shop) is Sperco Impex OÜ (registry code 14417809), located in Tallinn, Mustamäe tee 50.
Validity of the sales contract, information on goods and prices
The purchase conditions are valid for the purchase of goods from the online store. The prices of the products sold in the online store are indicated next to the products. The cost of delivering the goods will be added to the price. The cost of delivering the goods depends on the location of the buyer and the manner of delivery. The cost of the delivery is displayed to the buyer when placing the order. The information about the goods is indicated immediately adjacent to the goods, in the online store. The prices of the goods sold in the online shop are presented next to the goods in Euros (€) and include all taxes but do not include delivery costs. The delivery costs are added to the price of the goods.
Presenting an order
The goods must be added to the shopping cart to purchase the desired products. To complete the order, the required data fields must be completed and the suitable delivery method of the goods selected. The display then shows the amount payable that can be paid through a bank link or another payment solution. The contract comes into force when the amount payable for the goods reaches the bank account of the online shop. The buyer is informed if the goods ordered cannot be delivered due to insufficient stock or for any other reason, and the amount paid is refunded (incl. costs for the delivery of the goods) immediately but no later than 14 days after the notification has been sent.
The buyer is considered to have violated the contract and no longer desires the goods if the buyer does not collect the goods within 30 days of the agreed-upon date for the delivery of the goods. The seller has the unilateral right to withdraw from the sales contract and demand compensation for damages (e.g. the cost of the storage of the goods) and to offset the damage borne by the seller, with the amount of prepayment made by the buyer.
The buyer must take into consideration that, due to the technical peculiarities of calculating the inventory of Audiomarket Goods, the actual amount of stock of Goods is displayed with a time lag, so this may be different from the actual stand. The Buyer must also take into consideration that the Goods desired by him/her are booked from the Seller’s inventory position to the Buyer only after payment for the Goods, according to the conditions stipulated in the Conditions and presentation of an invoice for the Goods by the Seller. The Seller is therefore not responsible if the Goods desired by the Buyer, when starting the order, are indicated as “Product in stock” but at the moment of signing the transaction for the purchase and sale, it becomes apparent that the Goods desired by the Buyer have run out (“Sold out”) of stock from the Seller’s warehouse. The transaction for the purchase and sale between the Seller and the Buyer is not signed, in the latter case, concerning such Goods, and the Seller is not responsible to the Buyer for any damages that may result. The Seller is also not responsible if, immediately after payment by the Buyer for the Goods, it becomes apparent that the Goods desired by the Buyer have run out from the Seller. The Seller has the right in such a case to withdraw from the transaction for the purchase and sale and the Buyer does not have the right, in such circumstances, to demand from the Seller the fulfilment of the transaction for the purchase and sale as well as compensation for possible damages.
Currency
Payments are accepted in Euros.
Delivery
Purchases starting from €200 are delivered free of charge throughout Estonia. Goods are delivered within Europe. The shipping costs are borne by the buyer and the corresponding price information is displayed with the shipping mode. The delivery methods are Itella Smartpost parcel terminals, Omniva parcel terminals and Omniva courier. Shipments within Estonia usually reach the destination established by the buyer within 3-7 working days of the entry into force of the sales contract. Deliveries to areas outside of Estonia take place within 40 calendar days. The right of delivery within 45 calendar days exists in exceptional cases.
The right of withdrawal
The buyer has the right, within 14 days after receiving the order, to withdraw from the contract signed in the online shop. The right of withdrawal is not applicable if the buyer is a legal person. To use the 14 day right of return, the goods ordered must not be used in any other way than for being convinced of the nature, characteristics and functioning of the goods, in a fashion similar to that as allowed in a physical shop. The online shop has the right to reduce the refundable amount according to the reduction in the value of the goods, if the goods have been used for purposes other than those necessary for being convinced of their nature, characteristics and functioning of the goods or the goods have signs of use or wear. An application for the withdrawal from the purchase of the goods must be submitted, at the latest within 14 days of receipt of the goods, to the e-mail address info@audiomarket.ee, to return the goods. The costs of returning the goods are borne by the buyer, except in the case that the reason for the return lies in the circumstances that the item subject to return does not correspond with what was ordered (e.g. incorrect or defective item). The buyer must return the goods within 14 days of the submission of the application or provide proof that he/she has delivered the goods to the carrier within the aforementioned period. The online shop, upon receiving the goods to be returned, returns without delay, but no later than 14 days have passed from the receipt of the application for withdrawal, all payments received from the buyer based on the contract. The online shop may refuse to make refunds until it has received the item that is the object of the contract or until the buyer has presented proof that he/she has sent the item back, depending on which occurs first. The online shop is not obligated to refund the cost, which exceeds the cost associated with the regular method of delivery, if the buyer has explicitly selected a method of delivery that is different from the cheapest normal method of delivery. The online shop has the right to withdraw from the sales transaction and to demand back the goods from the buyer if the price of the goods in the online shop has been indicated as a result of a mistake, as significantly cheaper than the market value of the goods.
The right to submit a complaint
The Seller has the right to offset the decrease in the value of the Goods from the amount paid by the Buyer for the Goods and the amount refundable to the Buyer if the Goods (and/or the packaging of the Goods) returned by the Buyer have deteriorated, been broken or damaged, and such deterioration/damage is caused by circumstances arising from the Buyer. The Buyer is responsible for the decrease in the value of the Goods if the decrease in the value of the Goods has been caused by the use of the Goods through a fashion other than required for being convinced of the nature, characteristics and functioning of the item. The Buyer must handle and use the item solely in the fashion that is possible to do, when purchasing the goods from a retail store, for the method of use to qualify as authorised.
The online shop is responsible for the lack of conformity or deficiencies relative to the contract conditions of the goods sold to the buyer that already existed when the item was delivered and which become apparent within two years from the time that the goods were delivered to the buyer. It is assumed that within the first six months of delivery of the item to the buyer that the deficiency already existed at the time of the delivery of the item. It is the responsibility of the online shop to rebut the corresponding assumption. The buyer has the right to contact the online shop, at the latest within two months, if a defect is found by sending an e-mail to info@audiomarket.ee or by calling: +372 56602728. The online shop is not responsible for defects that have occurred after the goods have been delivered to the buyer. The online shop will repair or replace the goods purchased from the online shop if the goods purchased from the online shop have faults which the online shop is responsible for. The online shop will return to the buyer all payments related to the sales contract if it is not possible to repair or replace the goods. The online shop replies to the written, or format reproducible in writing, complaint of the consumer within 15 days.
Processing of personal data
The online shop uses personal data entered by the buyer (incl. name, telephone number, address, e-mail address, bank details), for processing the order and sending the goods to the buyer only. The online shop transfers personal data to companies providing transport services to deliver the goods. The online shop will send the buyer newsletters and offers to the buyer’s e-mail address only if the buyer has expressed a desire for it by entering their e-mail address on the website and having given notice of his/her desire to receive direct mail messages. The buyer can, at any time, withdraw from receiving offers and newsletters by e-mail by informing us thereof by sending an e-mail or following the directions in the e-mail containing the offers.
Settlement of disputes
Complaints by the buyer concerning the online store must be sent to the e-mail address info@audiomarket.ee or by calling: +372 56602728. The buyer can turn to the Consumer Disputes Committee if the buyer and the online shop are not capable of resolving the dispute by agreement. It is possible to acquaint oneself with the conditions of proceedings and to present an application through the Consumer Disputes Committee. The competency of the Consumer Disputes Committee is to resolve disputes arising from a contract signed between the buyer and the online shop. The review of the buyer’s complaint by the committee is free of charge. The buyer may turn to the platform of the European Union to resolve consumer disputes.
