Terms of Sale

The owner of the online shop audiomarket.ee (hereinafter referred to as the Online Shop) is Sperco Impex OÜ (registration code 10510989), located in Estonia, Harju County, Tallinn, Kristiine district, Mustamäe tee 50, 10621.

Validity of the Sales Agreement, Product, and Price Information

These Terms of Sale apply when purchasing goods from the Online Shop or purchasing goods via means of communication. The prices of products sold in the Online Shop are indicated next to the products and include local VAT tax and delivery fee. Information about the product is presented directly next to the product in the Online Shop.

Placing an Order

To order goods, the desired products must be added to the shopping cart. To complete the order, required fields must be filled in the shopping cart, and a suitable delivery method selected. The payment amount will then be displayed on the screen, which can be paid via bank link, credit card, installed payment solutions or other payment methods.

The contract comes into force once the amount due has been credited to the Online Shop’s bank account. If the ordered goods cannot be delivered due to being out of stock or for other reasons, the buyer will be notified as soon as possible, and the paid amount (including delivery costs) will be refunded, typically within 1-2 business days. Depending on the payment method, receipt of the refund may take up to 7 business days.

Delivery

Goods are shipped to the following countries: Estonia, Latvia, Finland, Lithuania, Sweden, Poland, Austria, Belgium, Bulgaria, Spain, the Netherlands, Croatia, Italy, Greece, Cyprus, Luxembourg, Malta, Monaco, Portugal, France, Romania, Germany, Slovakia, Slovenia, Denmark, Czech Republic, and Hungary.

Domestic shipments within Estonia typically reach the buyer’s designated destination within 1-3 business days from the contract coming into force. Outside Estonia, delivery will take place within 10 calendar days. In exceptional cases, goods may be delivered within up to 30 calendar days. If the Online Shop has notified the buyer on the website or in the order confirmation of delivery issues and a delivery period exceeding 30 calendar days, the period published by the Online Shop shall apply.

14-Day Right of Withdrawal

After receiving the ordered goods, the buyer has the right to withdraw from the contract concluded in the online shop within 14 days.

The right of withdrawal does not apply to the following goods: – products made according to the buyer’s personal needs, – audio and video recordings or computer software in sealed packaging if the seal has been opened after delivery, – goods in sealed packaging that are unsuitable for return due to health or hygiene reasons if the packaging has been opened after delivery.

The right of withdrawal does not apply if the buyer is a legal entity.

To exercise the 14-day right of withdrawal, the ordered goods must not be used beyond what is necessary to determine the nature, characteristics, and functioning of the goods, in a manner permitted for testing in a physical store. If the goods have been used for purposes other than necessary to determine their nature, characteristics, and functioning, or if there are signs of use or wear, the Online Shop reserves the right to reduce the refundable amount based on the decrease in the value of the goods.

The consumer must open the original packaging carefully and without causing damage, except when it is impossible to open the packaging without damaging it. The returned goods must be complete (including the product packaging and all items included in the package, such as cables etc.). If the condition of the returned goods deteriorates due to the consumer’s use, they are liable for the reduction in value only if the goods have been used in a way that goes beyond confirming their nature, characteristics, and functioning.

To return the goods, a withdrawal notice must be submitted by email to info@audiomarket.ee within 14 days of receiving the goods.

The email containing the withdrawal notice must include:
– order or invoice number
– date of order
– date of receipt of goods
– consumer’s name
– consumer’s address
– date of submission of the notice.

The buyer bears the cost of returning the goods, except if the return is due to the goods not matching the order (e.g., wrong or defective item).

The buyer must return the goods within 14 days of submitting the withdrawal notice or provide proof that they handed over the goods to the carrier within this period. Upon receiving the returned goods, the Online Shop will immediately, but no later than 14 days from the receipt of the withdrawal notice, refund all payments received under the contract. The Online Shop may withhold the refund until it has received the returned goods or until the buyer provides proof that the goods have been returned, whichever occurs first. If the buyer has expressly chosen a delivery method different from the Online Shop’s offered standard delivery method, the Online Shop is not obligated to refund the excess cost beyond the standard delivery.

If the consumer orders goods from the online shop for pick-up at the Audiomarket store, they have the option to inspect the ordered goods at the time of collection and to ask the seller additional questions about the goods. We recommend inspecting the goods to ensure they meet expectations and needs. If the consumer wishes to withdraw from the transaction, Audiomarket will promptly refund the total amount paid for the order to the customer’s account, but no later than 14 days.

The Online Shop reserves the right to withdraw from the sale and demand the return of goods if the price of the goods in the online shop was significantly below the market price due to an error.

Terms for Submitting a Product Claim

The online store is liable for any non-conformity or defect in the goods sold to the Consumer that existed at the time of delivery and that becomes apparent within two years from the date of delivery to the Consumer. Within the first year from the date of delivery to the Consumer, it is presumed that any defect was already present at the time of delivery. It is the obligation of the online store to rebut this presumption. The Consumer has the right to contact the online store about a defect no later than two months after the defect appears, either by emailing info@audiomarket.ee or calling +372 5451 2909.

The two-year right to submit a claim does not apply if the purchaser is a legal entity. For legal entities, the manufacturer’s warranty period of one year applies.

The online store is not liable for defects in the product in the following cases:
– The defect has resulted from improper storage, care, or overloading of the product, including any repairs or maintenance performed by an unauthorized person.
– The device’s and/or part’s serial number, inspection sticker, or marking sticker has been tampered with, replaced, or removed.
– The Consumer was informed of the defect before purchasing the product.
– The defect is due to external factors, such as lightning, non-compliant electrical voltage and fluctuations, moisture, liquids, mechanical damage, or similar causes.

If a product purchased from the online store has a defect for which the online store is liable, the online store will repair or replace the defective product. If repair or replacement is not possible, the online store will refund the purchaser for all fees associated with the sales contract.

The online store will respond to the consumer’s complaint in writing or in a form that allows written reproduction within 15 days.

Purpose of Processing Personal Data

Personal data is used to manage customer orders and deliver goods.

Purchase history data (purchase date, product, quantity, customer information) is used to provide an overview of goods and services purchased, analyze customer preferences, and for purposes such as resolving consumer disputes.

The bank account number is used to process refunds to the customer.

Personal data such as email, phone number, and customer name are processed to address issues related to the provision of goods and services (customer support). Email is also used for sending invoices, and the phone number is used to notify the customer when goods have arrived at a parcel terminal.

The IP address or other network identifiers of the online store user are processed for providing the online store as an information society service and for creating website usage statistics.

Legal Basis

The processing of personal data is carried out for the purpose of fulfilling the contract concluded with the customer (managing customer orders, delivery, and refunding goods and payments).

The processing of personal data is also conducted to comply with a legal obligation (e.g., accounting) and is necessary for the legitimate interests of the data controller, which lie in the collection of purchase history data for the purpose of resolving potential consumer disputes.

Recipients to Whom Personal Data is Transferred

Name, phone number, and email address are transferred to the transportation service provider selected by the customer. If a courier is involved in delivering the goods, the customer’s address is also transferred in addition to the contact information.

Security and Access to Data

Personal data is stored on the servers of Zone Media OÜ, located within the European Economic Area.

Access to personal data is restricted to online store employees who may review personal data to resolve technical issues related to the use of the online store and to provide customer support services. The online store implements appropriate physical, organizational, and IT security measures to protect personal data against accidental or unlawful destruction, loss, alteration, unauthorized access, and disclosure.

The transfer of personal data to authorized processors and recipients (e.g., transportation service providers and data hosting services) is conducted based on contracts concluded between the online store and the authorized processors. Authorized processors are obligated to ensure appropriate protective measures are in place for processing personal data in accordance with Article 28 of the General Data Protection Regulation (GDPR).

Access to and Correction of Personal Data

Personal data can be accessed and corrected through the online store user’s profile or via customer support. If a purchase is made without a user account, personal data can be accessed through customer support. If a request to access personal data is submitted electronically, the information will also be provided through commonly used electronic means.

Withdrawal of Consent

If the processing of personal data is based on the customer’s consent, the customer has the right to withdraw consent under their account settings or by notifying customer support via email.

Data Retention

Upon closing the online store customer account, personal data is deleted, except for personal data (purchase history data) that must be retained for accounting purposes or for resolving consumer disputes. In cases of disputes related to payments and consumer complaints, personal data is retained until the claim is fulfilled or until the expiration of the limitation period. Personal data contained in accounting source documents is retained for seven years.

Restriction

The customer has the right to request the restriction of the processing of their personal data if the data is inaccurate or incomplete, or if their personal data is being processed unlawfully.

Objections

The customer has the right to object to the processing of their personal data if they have grounds to believe that there is no legal basis for processing their personal data.

Deletion

To request the deletion of personal data, contact customer support via email. The deletion request will be responded to no later than one month, specifying the period for data deletion. The response will also indicate which personal data will not be deleted and the legal basis and reasons for retaining that data.

Data Transfer

Requests for the transfer of personal data submitted via email will be responded to within one month. Customer support will verify the identity of the requester and inform them about which personal data will be transferred.

Direct Marketing Communications

The email address and phone number are used to send direct marketing communications if the customer has given corresponding consent. If the customer does not wish to receive direct marketing communications, they must select the appropriate link in the email footer or contact customer support.

If personal data is processed for direct marketing purposes (profiling), the customer has the right to object at any time to both the initial and further processing of their personal data, including profiling related to direct marketing, by notifying customer support via email. (Such information must be provided clearly and separately from any other information.)

Dispute Resolution

If the consumer has complaints regarding the online store, they should send them to the email address info@audiomarket.ee or call the phone number +372 5451 2909.

If the consumer and the online store are unable to resolve the dispute through agreement, the consumer has the option to turn to the Consumer Disputes Committee. The procedural conditions can be reviewed, and a complaint can be filed here.

The Consumer Disputes Committee has the authority to resolve disputes arising from contracts between the buyer and the online store. The examination of the buyer’s complaint in the committee is free of charge. The buyer may also contact the European Union Online Dispute Resolution (ODR) Platform for assistance.

The supervisory authority for the processing of personal data is the Estonian Data Protection Inspectorate (contact: info@aki.ee).
